Reflections on Migrant Detention in Albania

Today, six judges of the Immigration section of the single-judge court of Rome are meeting to deliberate on the detention orders of seven migrants in the Italian center in Albania. The issue is further complicated by the decree on Safe Countries, which has raised a heated debate between politicians and the judiciary. The Minister of Justice, Carlo Nordio, has expressed the need for a constructive discussion, inviting magistrates to avoid criticizing the laws in force.

The president of Magistratura Democratica, Silvia Albano, denounced the current situation, stating that the government is responsible for the political conflict. Tensions have risen ahead of the judges’ decision on the detention of migrants. Expectations are high, with many predicting similar rulings to those issued on October 18, when the detention of twelve migrants was rejected.

The Words of President Albano

Silvia Albano shared her concerns at a conference in Rome dedicated to the 60th anniversary of Magistratura Democratica. She stressed that her position as a judge has exposed her to threats and intimidation. In her words, she does not intend to enter into conflict with the government; rather, she has been chosen as a “lightning rod” in a campaign against the judiciary. Albano also rejected criticism leveled against him by Deputy Prime Minister Matteo Salvini, saying that the judiciary is based on the Constitution and not on political ideologies.

The Future of the Relationship between Politics and the Judiciary

The National Association of Magistrates (ANM) fears an escalation of controversy. Giuseppe Santalucia, leader of the union, said it is essential to maintain an open dialogue without politicizing judicial decisions. Nordio proposed a roundtable to improve communication between the government and the judiciary. However, Albano stressed the importance of involving experts in the creation of laws to avoid conflicts with constitutional and European principles. Concluding this heated debate, it remains to be seen how the interaction between politics and justice will influence future decisions regarding immigration and related laws. At a time when fundamental rights are at the center of public attention, a deeper reflection could prove crucial for the future of Italian legislation.
