Tensions between justice and politics in Italy: waiting for the pronouncement on migrants
The climate of anticipation is becoming increasingly tense in Italy, as judges prepare to pronounce their decision on the detention of migrants in Albania, a topic that has sparked political and legal controversy. With the shadow of the “Safe Countries” decree looming, expectations are high, especially after the sentences of last October 18 that rejected the detention of twelve migrants.
The magistrates' point of view
During a conference dedicated to the 60 years of Democratic Magistracy, Silvia Albano, president of the association and judge of the immigration section of the Rome court, expressed concern about the current situation.
“What has happened so far is already very serious and problematic,” Albano said, drawing attention to her controversial role in not validating the detention of a migrant. Since this decision, the magistrate has received threats via email and social media. She described this situation as an “intimidation campaign” against her.
Albano made it clear that he does not intend to confront the government in a direct clash, but at the same time he underlined that it is the government that wants to provoke conflicts with the judiciary.
The government’s response and the concerns of the ANM
Giuseppe Santalucia, leader of the National Association of Magistrates (ANM), indicated that the current atmosphere is even more tense than that of previous governments. According to him, it is essential that the sentences be understood in their legal context rather than politicized.
Francesco Paolo Sisto, Deputy Minister of Justice, warned: while it is legitimate to criticize laws, it is essential not to interfere in legislative processes and to respect the right to confidentiality of judicial decisions.
A look to the future
Tensions between politics and the judiciary raise questions about the future of the Italian legal system. The need for constructive dialogue is increasingly evident; however, the risk of politicization of sentences remains a delicate issue. As Albano underlined, involving experts in the formulation of laws could lead to more balanced and constitutional results.
