Abi suggests that explicitly excluding private entities from the scope of the rule could prevent possible legal ambiguities. Furthermore, the obligation for private companies to comply with spending containment measures could raise questions of constitutionality.

The Importance of the Ace and the Guarantee Fund

The abolition of the ACE has impoverished the tools available to businesses, according to ABI. The association hopes for its reintroduction because mechanisms such as the ACE can promote:

The association argues that it is essential to maintain the current operational capacity of the Fund and confirm the regulation introduced with the Anticipi Decree to ensure its continuity in supporting businesses. An adequate refinancing for 2025 is considered equally crucial.
