Reform of beach concessions: approval and controversy

The Senate recently approved the reform of concessions for beach resorts, a measure that has sparked contrasting reactions among the various categories involved. With 100 votes in favor, 63 against and 2 abstentions, the Infractions decree becomes law, aiming to resolve 15 infringement procedures opened by the European Union against Italy. However, the issue of beach resorts is proving to be particularly sensitive, sparking a series of controversies.

Reactions from the beach category

The beach resort category has expressed its dissatisfaction with the measure, stating that it is ready to mobilize. The beach resort unions have expressed concern about the lack of dialogue with the government, stressing that the text does not adequately address the scarcity of the resource, which is fundamental for the application of the Bolkestein Directive.

According to industry organizations, the expected compensations are considered “derisory” and do not reflect the investments made in the last five years, a period marked by the pandemic and uncertainty over concessions. Furthermore, the exclusion from Bolkestein of only sports clubs has been criticized, while beach resorts continue to remain under the concession regime.

Details of the measure

The new decree provides for the extension of beach concessions until September 30, 2027 and establishes compensation for outgoing concessionaires. These compensations will be calculated on the value of investments made and not yet amortized at the end of the concession. The “save-clubs” rule will apply to sports associations that use the maritime state property only for recreational and social purposes. The new procurement procedures must be concluded by 30 June 2027, but despite attempts at mediation between the government and the European Commission, further extensions of compensation have been renounced.

Towards an uncertain future

With the approval of the reform of beach concessions, a new chapter opens in the Italian tourism sector. However, the controversies and requests for clarification by beach operators highlight the need for a more constructive dialogue between the government and the interested categories. The issue of sustainable management of coastal resources remains central, raising questions about how these new rules will affect the balance between economic development and environmental protection in the near future.
