Situation of migrants in Italy and Albania

Libra recently collected a group of migrants to be transferred to Albania, consisting of 6-8 people. However, Italian judges continue not to validate the detentions in the centers, despite the decree law approved on October 21 which updated the list of Safe Countries.

Court rulings

Today, the Catania court considered the situation of three Egyptians and two Bangladeshis. Deputy Prime Minister Matteo Salvini expressed his disappointment, stating:

“Because of some communist judges who do not apply the laws, the unsafe country is now Italy. But we will not give up!” The conflict between judges and the government intensifies. Despite the decree aimed at overcoming the ruling of the European Court of Justice of June 4, recent developments have not led to concrete results.

Reflections on Countries Considered Safe

The judges of Catania have questioned the validity of the list of safe countries, highlighting that:

“A list of ‘safe countries’ does not exempt the judge from the obligation to verify compatibility with European Union law.” They stressed that Egypt has serious human rights violations and is one of the countries with the highest number of executions in the world. Bangladesh has also been subject to a similar analysis, leading to the non-validation of detention for five asylum seekers. The Rome court has adopted a similar decision, suspending the denial of the asylum request for one of the migrants transferred to Albania.

The reaction of politics

The majority, including members of Prime Minister Giorgia Meloni’s party, criticized the judges' decisions. Tommaso Foti said:

“The claim, by some judges, to replace Parliament is out of place.” On the other hand, the opposition called on the government to stop “this dangerous game for the institutions”. The plan for transfers to Albania continues despite difficulties. After a first failed attempt, Libra has resumed the process with a new group of asylum seekers. Interior Minister Matteo Piantedosi remains optimistic: “I am confident… The Albania project will continue anyway.” By 2026, a new European regulation will come into force, making it necessary for Italy to adapt to the new regulations.
